3. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied or used on BeautySignature in a way that constitutes copyright infringement, you may submit a DMCA takedown notice to our Copyright Agent.

3.1 Requirements for a Valid Notice

To be effective, your DMCA notice must include ALL of the following information pursuant to 17 U.S.C. § 512(c)(3):

    Provide your physical or electronic signature (typing your full name constitutes an electronic signature).

3.3 What Happens After You File

  1. Receipt Confirmation
    We'll acknowledge receipt of your notice within 24-48 hours
  2. Review Process
    Our team reviews the notice for completeness and validity
  3. Content Removal
    If valid, we remove or disable access to the allegedly infringing content within 3-5 business days
  4. User Notification
    We notify the user who posted the content of the takedown and provide information about filing a counter-notice

4. Filing a DMCA Counter-Notice

If you believe that content you posted was removed or disabled in error or misidentification, you may file a DMCA counter-notice.

4.1 Requirements for a Valid Counter-Notice

Your counter-notice must include ALL of the following information pursuant to 17 U.S.C. § 512(g)(3):

  1. * Your contact information:
    Full name, address, phone number, and email address
  2. * Identification of removed content:
    Description of the content that was removed and the location where it appeared before removal
  3. * Statement under penalty of perjury:
    Include the following: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
  4. * Consent to jurisdiction:
    Include the following: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the jurisdiction where BeautySignature is located if my address is outside the United States), and I will accept service of process from the person who filed the original DMCA notice or their agent."

4.2 Counter-Notice Process

  1. Submit Counter-Notice
    Send to legal@beautysignature.co with subject "DMCA Counter-Notice"
  2. Review & Forward
    We review the counter-notice and forward it to the original complainant
  3. Waiting Period
    We wait 10-14 business days to see if the complainant files a lawsuit
  4. Content Restoration
    If no lawsuit is filed, we may restore the content after the waiting period

5. Repeat Infringer Policy

Three-Strike Policy

BeautySignature has adopted a policy of terminating accounts of users who are repeat copyright infringers in accordance with 17 U.S.C. § 512(i).

5.1 How It Works

  • First Violation: Warning and content removal
  • Second Violation: Temporary account suspension (7-30 days) and content removal
  • Third Violation: Permanent account termination

5.2 Consequences of Termination

Users terminated for repeat infringement:

  • Lose access to all premium content and features
  • Forfeit any remaining subscription period (no refunds)
  • Are prohibited from creating new accounts
  • May be reported to relevant authorities if warranted

6. Misrepresentation Warning

Legal Consequences

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability for damages, including costs and attorney's fees.

Do not file a false DMCA notice or counter-notice. Doing so can result in:

  • Civil liability for damages
  • Payment of the other party's legal fees
  • Criminal charges for perjury
  • Permanent ban from BeautySignature

7. Limitations

7.1 What DMCA Does NOT Cover

The DMCA process is only for copyright infringement. It does not apply to:

  • Trademark violations: Contact us separately about trademark issues
  • Defamation: Not covered under DMCA; consult an attorney
  • Privacy violations: Report via privacy@beautysignature.co
